Data Protection Policy

The confidentiality of customer and member information is of paramount concern to Method Wellbeing Ltd. To this end, we comply with UK data protection legislation and medical confidentiality guidelines.

Everyone who works at Method Wellbeing has a duty of confidentiality. Confidentiality is a key aspect within training and compliance with Bupa policies and guidelines are actively monitored; non compliance may result in disciplinary action being taken.

Method Wellbeing has taken the appropriate technical and organisational measures against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, this data. To this effect Method Wellbeing maintains information security policies, rules, standards and guidelines at all levels incorporated within the International Standard for Information Security (ISO/IEC 27001).

Full Details of Our Terms and Conditions 

These terms and conditions of service together with any terms and policies referred to in them constitute a legally binding agreement between you and Method Wellbeing Ltd (“We”). We are registered in England and Wales under company number 10027402 and have our registered office at 100 Fenchurch St, London EC3M 5JD.

Method Wellbeing Ltd provides a booking service via our website and over the phone for for a range of various types of Pilates & Yoga classes and wellness services that are performed in each and every case by independent self-employed professional Pilates and/or Yoga teachers (“Independent Teachers”). In providing this booking service,  Method Wellbeing administer the relationship between such Pilates and Yoga teachers and clients. Method Wellbeing has no responsibility for any Pilates classes or Yoga classes that you book through us: we are simply involved with the booking process.

When booked by us, the session you receive will be subject to the Independent Teachers liability waiver which is included below. Method Wellbeing is not a party to any booking agreement; this will solely be between you and the Independent Teacher who provides you with their services.

Our Terms govern your use of our website and our telephone booking services (collectively ”Our Booking Services“). By using Our Site or Our Booking Services, you agree to abide by Our Terms. Please read Our Terms carefully and thoroughly. If you do not accept Our Terms, you must not make a booking through Method Wellbeing for any services.

In order to provide Our Booking Services, we may collect personal data from you. Before making a booking with us please read our privacy policy available here – Our Privacy Policy

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 requires Method Wellbeing to give you certain key information for there to be a legally binding contract between you and us. This information is set out below. Details on how to make a booking are set out below. If we wish to change any key information once a legally binding contract is made, we can only do this if you agree to it.

We only conclude contracts in the English language.

Eligible Use

You confirm that you are of legal age to access and use Our Site and/or Our Booking Services and of legal capacity to agree to Our Terms. You are not eligible to use Our Booking Services if you are under the age of 18.

Usage

When registered on Our Site you will be able to submit a request for a booking at a time and place of your choosing, and connect you with an available Independent Teacher.

Booking Process & Payment

You can make a booking request through Our website by stating the time, place and type of lesson required.

Your payment details will be requested at the time of booking and payment. Full payment of the service fee is due at the time of booking.

The Class Fee belongs to the Independent Teacher who provides the services. Method Wellbeing collects the Fee from you as their agent. For each booking made through us, we charge the relevant Independent Teacher an agreed fee (plus any VAT payable thereon) for introducing you to the service provider. We have an agreement with each Independent Teacher under which we are entitled to deduct Our Agent’s Fee from the Service Fee paid.

We will do all that we reasonably can to ensure that all of the information you give us when paying for the secure is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on the part of Method Wellbeing, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you may give us at any time.

All payments by credit card or debit card need to be authorised by the relevant card issuer. We may also need to use extra security steps via Verified by Visa.

By making a booking you agree to provide complete, correct and true information including without limitation billing and payment information.

Once your booking is accepted and confirmed by the Independent Teacher, you will receive confirmation of your lesson.

By making a booking, you are responsible for:

• Full payment of the applicable Class Fee;

• Ensuring the Independent Teacher has access to your Designated Premises which must, in all cases, represent a suitable space in which the service can be performed, with all appropriate facilities (including, adequate lighting and heating); and

• Ensuring the health and safety of the Independent Teacher whilst at your Designated Premises.

All Class Fees are payable through Our website or over the telephone as part of our booking service.

Prices

The price of our services (each a “Service Price” and collectively “Service Prices“) varies according to the type, the number of participants, whether it is a corporate or private class and also the duration. 

Customer Responsibilities

In addition to the responsibilities noted above, it is your responsibility to provide complete and accurate information at the time of booking. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your booking or an inability of the booked Independent Teacher to provide the service as requested. Such failure may also result in loss or incorrect delivery of your booking confirmation.

If you want to reserve a specific time slot with your teacher please schedule at the time of purchasing your package. We will always do everything we can after this point to accommodate and schedule sessions when most convenient for you, but we can’t guarantee your chosen slot will be available if you don’t schedule when you book your package.

Cancellation & Rescheduling Policy

You acknowledge that you do not have the right to cancel a booking under statutory regulation. However, you are entitled to cancel bookings in accordance with this clause.

If you change your mind about your booking prior to the appointment time, then you may cancel your booking but a cancellation fee will be charged as per below. Any cancellations of your bookings should be made by email to contact@mymethod.co.uk or by calling the office between 9am – 6pm, Monday – Friday on  0203 7642657

Cancellation Fees

Private Classes

Up to 24 hours prior to class commencement, all sessions can be rescheduled or cancelled with no charge.

For cancellation or rescheduling with 24 hours or less prior to class commencement, there will be a 100% charge of the booking fee amount.

Corporate Classes

Up to 72 hours prior to class commencement, all sessions can be rescheduled or cancelled with no charge.

For cancellation or rescheduling with 72 hours or less prior to class commencement, there will be a 100% charge of the booking fee amount.

You will be charged the full booking fee if you:

• Cancel a booking other than permitted above

• Attempt to cancel a booking on or after the appointment time

• Fail to attend a booking at the appointment time and/or at the correct location.

We charge a cancellation fee to compensate the teacher because the teacher will unlikely be able to make another booking where you cancel with short or no notice. We may waive our right to cancellation fees in our sole discretion in exceptional circumstances.

Refunds are not available on block/package bookings. We offer a money back guarantee on the first session only.

The client must contact Method Wellbeing by email (contact@mymethod.co.uk) or telephone (0203 7642657) to cancel or reschedule an appointment.

Extensions & Delays

If you wish to extend the time you have booked, the teacher will endeavour to fulfil your request subject to availability and this will require another additional booking on the App (subject to min 45 time slot). If you are delayed and unable to meet your booked appointment time in excess of 10 minutes, the end time of your class will not be extended. If you are late in commencing your class by less than 10 minutes, the teacher is not obligated but may, at his/her sole discretion extend the class to provide the full booked time for your class.

Method Wellbeing Ltd IS ONLY AN INTRODUCER

Our Booking Services enable those seeking Pilates and Yoga Services to book appointments with Independent Teachers seeking to provide such Services. Whilst Method Wellbeing interviews and assesses Independent Teachers who wish to provide Services, we do not guarantee or warrant, and make no representations regarding the reliability, quality or suitability of Independent Teachers. This is entirely a matter for you. Accordingly, you acknowledge and agree that Method Wellbeing does not have any obligation to conduct any background checks on any Independent Teachers and have no obligation in respect of any service they may provide.

When interacting with any Independent Teachers you should exercise caution and common sense to protect your personal safety, details and property, just as you would when interacting with other persons who are unknown to you.

Waiver of Liability

To ensure your well-being, we require you to read and accept this form before booking Pilates or Yoga services.

Method Wellbeing Ltd has permission to store this information on behalf of the independent teacher. In addition, the independent teacher may take notes of the information that you provide or/and which she observes from your sessions. This may include details about your health and standard of living. All notes are used to enhance your well-being & experience with Method Wellbeing Ltd.  Your rights in relation to such information are set out in our Privacy Policy.

Please read the following to confirm your understanding and acceptance.

I understand that Pilates and Yoga include physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, discontinue the activity, and ask for support from the instructor. I assume full responsibility for any and all risks, injuries or damages, known or unknown, which may incur through participation on any given day.

I understand that Pilates and Yoga sessions are not a substitute for medical care and that prior to my lesson I have informed Method Wellbeing Ltd and the represented independent Pilates or Yoga teacher of my choice of all known medical conditions and injuries. By accepting the terms and conditions, I affirm that I am physically able to practice Pilates or Yoga and do herby agree that Method Wellbeing Ltd & the represented independent Pilates or Yoga teacher is not responsible or liable to me for any injury, accident, or loss of personal property. I verify my good health and physical condition to participate. In addition, I will make Method Wellbeing Ltd & the independent Pilates or Yoga teacher aware of any medical conditions or physical limitations before class. If I am pregnant, become pregnant or I am post-natal or post-surgical, my acceptance to terms and conditions verifies that I have my doctor’s approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga and participation is at my own risk. In further consideration of being permitted to participate in the Pilates or Yoga classes or retreats I knowingly, voluntarily and expressly waive any claim I may have against Method Wellbeing Ltd & the represented independent Pilates or Yoga teacher for any loss to personal property, injuries or damages that I may sustain as a result of participating in classes or retreats.

Prohibited Use

Our Booking Services are for your personal and non-commercial use and must only be used for the purposes of inquiring about or making bookings for Pilates or Yoga Services expressly described above. You must not use the Site, the Mobile App or Our Booking Services to do any of the following which are strictly prohibited:

• Engage in any inappropriate behaviour including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behaviour;

• Restrict or inhibit any other user from using and enjoying Our Booking Services;

• Infringe the privacy rights, property rights, or other civil rights of any person;

• Harass, abuse, threaten or otherwise infringe or violate the rights of Independent Teachers or Therapist, Method Wellbeing (including its employees and personnel) or others;

• Harvest, data-mine or otherwise collect information about others, including email addresses, without their consent;

• Use technology or other means to access our computer network, unauthorised content or non-public spaces;

• Introduce or attempt to introduce any viruses or any other harmful code, files or programs that interrupt or otherwise or limit Our Booking Services’ functionality;

• Damage, disable or otherwise impair our servers or networks or attempt to do the same; and

• Engage in or encourage others to engage in criminal or unlawful conduct or breach these Terms including misuse of Our Booking Services for unlawful or unauthorised purposes.

You agree not to breach these Terms in any way which may result in, among other things, termination or suspension of your access to Our Booking Services.

Intellectual Property

Method Wellbeing , the Method Wellbeing logo, brand and all other intellectual property rights, trademarks, service marks, graphics and logos used in connection with the Site or the Services (whether registered or unregistered) belong to us or our licensors (as are applicable) and are protected by intellectual property law. Nothing in these Terms grants you any rights in the Site or Our Booking Services or the content within the same. All rights are reserved.

Disclaimer

As noted above, we introduce individuals seeking Pilates and Yoga services to Independent Teachers seeking to provide such services. We are not liable or responsible for the fulfilment of any booking or the performance of the Independent Teacher. You acknowledge and agree that we are not responsible for addressing any claims you have as regards any Independent Teachers for the services provided on the platform.

Content on Our Site and App is made available as part of Our Booking Services is provided for your general information purposes only. Nothing contained on Our Site or App or communicated any other way as part of Our Booking Services constitutes, or is meant to constitute, advice, opinion or guidance of any kind. We are not a health care provider nor do we provide medical advice or medical treatment. The information presented on Our Site and App and otherwise as part of Our Booking Services is not intended to diagnose health problems or to take the place of professional medical care. Should you have a medical issue you should always consult with a qualified medical professional.

We make no warranty or guarantee that Our Site or any other aspect of Our Booking Services is suitable for your intended use, error-free, timely, reliable, entirely secure, virus-free or available. We make no guarantee of particular results or outcomes by use of Our Site, or any other aspect of Our Booking Services.

Nothing in Our Terms will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit and nothing in Our Terms will exclude or limit our liability in respect of any: death or personal injury caused by the negligence of Method Wellbeing, fraud or fraudulent misrepresentation by Method Wellbeing or any matter which it would be illegal or unlawful for Method Wellbeing to exclude or limit, or to attempt or purport to exclude or limit, its liability.

We are not liable or responsible for any errors in or failure to provide Our Booking Services due to your error or failure to provide accurate and complete information.

Whilst we make every effort to ensure that Our Booking Services are available, we do not represent, warrant or guarantee in any way the continued availability at all times or the uninterrupted use by you of Our Booking Services. We reserve the right to suspend or cease the operation of all or part of Our Booking Services from time to time at our sole discretion.

USE OF THIS SITE AND OUR BOOKING SERVICES IS ON AN “AS-IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED AT LAW IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF DATA, LOST REVENUES, LOSS OF GOODWILL, LOSS OF ANTICIPATED SAVING OR PROFITS, OR ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE OR SERVICES, OR WITH THE DELAY OR INABILITY TO USE THE SITE OR SERVICES, OR WITH THE PROVISION OF OR FAILURE TO PROVIDE THE SITE OR SERVICES.

Indemnity

You agree to defend and indemnify us from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, that arise from or relate to your use or misuse of, or access to Our Booking Services and otherwise from your violation of Our Terms.

Modification & Termination

We may modify Our Terms or terminate use of Our Booking Services at any time by giving notice of termination to you. The Class Prices may also change from time to time. We may also change, suspend, terminate or discontinue any aspect of Our Booking Services including availability of certain features at any time for any reason.

Severability

If any provision of Our Terms is deemed or becomes invalid, the validity of the other provisions shall not be affected.

Governing Law & Jurisdiction

You agree that Our Terms for all purposes, shall be governed by and construed in accordance with English law. You also agree, subject to the following clause, to submit to the nonexclusive jurisdiction of the English courts as regards any claim or matter arising under these Terms.
